How football jackpots and pool betting work in Kenyan law
The Gambling Control Act, 2025 defines a jackpot as the highest prize in a game of chance, paid from a fixed schedule or from an accumulating pool. Pool betting means winners share, or are paid by reference to, the stakes. A licensee needs written authorisation and a ring-fenced deposit before it offers a jackpot.
Three words the Act keeps apart
Fans use "jackpot" for any game where you predict a list of matches for one big prize. The law is more careful. It separates the prize (a jackpot), the way winnings are calculated (pool betting) and the machinery that runs a pool (a totalisator).
All three are defined in section 2 of the Gambling Control Act, 2025. They sit beside the definition of a bookmaker, whose licence types are explained in the guide to checking a bookmaker licence in Kenya.

Fixed-odds bet or pool: where the prize comes from
In a fixed-odds bet you know the return when the bet is accepted. A stake at 2.10 pays 2.10 times the stake if it wins, however many other people backed the same result. The bookmaker carries the risk.
In a pool, the return is unknown until entries close and results are in. The operator takes its deduction from the pool and the rest is divided among the winners. More winners means a smaller share each.
Illustrative example. A pool collects KES 1,000,000. If 15% is deducted, KES 850,000 is left for prizes. Four winning entries would receive KES 212,500 each; forty would receive KES 21,250 each. The figures are invented to show the arithmetic.
For a holder of a totalisator licence, the Act sets a floor. Section 60(3) says the aggregate of returns on any event or combination of events "shall not be less than eighty-five per cent of the total amount pooled or such other amount, as may be approved by the Authority".
Who may run a pool or a jackpot
Pool betting has its own licence. Under section 61 of the Act the Authority issues a promoter's licence authorising a promoter to provide a pool betting scheme within Kenya, and one licence applies to one scheme at a time.
The definition of "bookmaker" in section 2 leaves out a person who operates a licensed totalisator and a person employed in a business that is wholly concerned with a licensed pool betting scheme. In other words, running a pool is a different activity from taking fixed-odds bets, even when the subject is the same weekend of football.
Jackpots cut across those categories. Regulation 81 of the Conduct of Gambling Operations Regulations, 2026 says a jackpot may be carried out by operators holding a bookmaking, public lottery, national lottery, casino, totalisator or pool betting licence.
What a licensee must do before offering a jackpot
Part X of the 2026 regulations deals with jackpots. Regulation 80 sets four conditions for a licensee that wants to offer one:
- Seek written authorisation from the Authority on Form 2 in the First Schedule.
- Pay the application fee prescribed in the Second Schedule.
- Submit proof of having opened a fixed deposit account "equal to the guaranteed jackpot amount separate from the operational account".
- Attach the terms and conditions of the jackpot for approval by the Authority.
The deposit account must be with a bank licensed by the Central Bank of Kenya. Evidence that the money is there goes to the Authority weekly if the jackpot is progressive and every fourteen days if it is fixed, or more often if the Authority directs.
Regulation 80(3) covers a prize that nobody hits: a jackpot not won for more than twenty-four months "shall be cascaded to lower combinations until the jackpot is won". For the reader, the practical point is that an advertised guaranteed amount is supposed to be backed by money set aside, and the rules of the game are supposed to have been approved before the first entry.
How big prizes are paid
Regulation 80(4) sends jackpot payments to the payment structure in the Third Schedule, headed "Online gambling prize payment tiers". The schedule sets the checks and the time allowed for each size of prize.

Two other rules sit alongside the schedule. Regulation 85(3) requires a licensee to verify the identity of any winner before payment of winnings. And section 70(5) of the Act says any claim against a licensee for an uncollected prize in an online gambling transaction lapses after six months from the date of declaration of the winnings.
What is an offence around pool betting
The Act treats unlicensed pools seriously. Section 103 makes it an offence to promote a pool betting scheme in breach of the terms of a licence, or to promote, receive or negotiate bets on behalf of a promoter of an unauthorised scheme. The penalty is a fine not exceeding one million shillings, imprisonment for up to one year, or both.
Section 104 goes further down the chain. In connection with an unauthorised pool betting scheme it covers printing coupons, selling or distributing them, distributing an advertisement of the scheme or a list of its prize winners, and sending money out of Kenya in respect of coupon sales. The same maximum penalty applies.
That is one reason to confirm who is behind a game before entering it. The licence list page reproduces the bookmaker entries from the regulator's list for the 2025/26 trading period.
The size of the task
A pick-all-results game asks for a perfect card. Each match has three possible results, so the number of different cards is 3 multiplied by itself once per match.
- Thirteen matches: 1,594,323 possible cards.
- Seventeen matches: 129,140,163 possible cards.
Matches are not coin tosses, so an informed card is somewhat more likely than a random one. The gap between "somewhat more likely" and "likely" is still enormous. It is the accumulator effect from the guide on margin in football odds, taken to its limit.
A large advertised prize does not change the cost of an entry or the chance of it winning. A jackpot entry is a small payment for a very small chance, and it should be budgeted like any other entertainment spend. It is never a plan for paying bills.
Reading the terms of a jackpot
Regulation 22 requires the terms and conditions of bookmaking, pool betting and totalisator operations to be in simple language, to state all significant conditions that may affect a punter's decision, and not to be misleading about the winnings or the manner of participation. They must be readily accessible for the duration of play.
Before entering, look in those terms for these points:
- Is the top prize fixed, or shared between all winning entries?
- What happens to the list when a match is postponed or abandoned?
- Are there prizes for near misses, and are they fixed or shared?
- Which deductions are taken from a prize before it is paid?
- How and where does a winner prove identity?

Very unlikely. With three possible results per match there are 1,594,323 different ways to fill in thirteen matches and 129,140,163 ways to fill in seventeen. Knowledge of football narrows the field a little, never enough to make the top prize a realistic expectation.
