How to dispute a football bet settlement in Kenya: the formal steps

Start with the licensee's customer care centre, which must try to resolve the complaint and refer an unresolved one to the Gambling Regulatory Authority. For an online bet, a party to the dispute may appeal to the Gambling Appeals Tribunal within fourteen days from the date of the dispute.

What counts as a settlement dispute

A settlement dispute is a disagreement over how a bet was resolved: marked as lost when you read the rules as a win, paid at a different return than the slip shows, voided, or left unsettled. It is not a complaint about the odds you chose or about a result you dislike.

Before you write to anyone, check the market rule that applies. Many disputes turn on whether a goal in added time counts, which is covered in does injury time count in football bets, or on how a void leg is treated, which is covered in how a football multibet settles with a void match.

What the licensee must do

A licensee must settle winning bets promptly and in accordance with the published rules. It must also hold internal dispute resolution mechanisms approved by the Authority, and it must keep a customer care centre. The table sets out the provisions that frame your complaint.

ProvisionWhat it saysWhat it means for you
Reg. 23(1)Betting odds, rules and terms applicable to each bet must be clearly displayedThe slip and the displayed rules are your reference text
Reg. 23(2)Terms of an accepted bet cannot be altered except as permitted by law or approved rulesA change after acceptance needs a basis in law or approved rules
Reg. 24(1)Winning bets are settled promptly and under the published rulesDelay and rule misapplication are both open to challenge
Reg. 24(2)A settlement dispute is handled under dispute resolution procedures approved by the AuthorityThere is a defined procedure, not only goodwill
Reg. 9(2)The customer care centre resolves complaints before they reach the Authority and refers unresolved ones for determinationThis is the first formal door
Reg. 103Internal dispute resolution mechanisms must be approved by the AuthorityAsk the licensee to name the procedure it is applying

Steps to take, in order

  1. Keep the bet slip, reference number, stake, odds, the market and the time of placement, and any notice about the settlement.
  2. Find the rule the licensee relied on and compare it with the terms shown when you placed the bet.
  3. Write to the customer care centre, state the bet, what you think the correct settlement is and why, and note the date you did so.
  4. If the answer does not resolve it, ask in writing that the matter be referred to the Authority for determination, as regulation 9(2)(e) provides.
  5. For an online bet, note that an appeal to the Tribunal is open for fourteen days from the date of the dispute, and decide before that period runs out.

Confirm that the company you are dealing with is on the register before you rely on any of this. The method is in how to check a bookmaker licence in Kenya.

The Authority and the Tribunal

Section 10(m) of the Gambling Control Act, 2025 lists among the functions of the Authority the receiving of, and making determination on, complaints from companies and the public on matters pertaining to games of chance. The Authority is therefore the body to which the customer care centre refers an unresolved complaint.

The Gambling Appeals Tribunal is a separate body. Under section 88(9) it hears and determines appeals against any decision of the Authority, and complaints arising out of the outcome of a gambling transaction. Section 80 gives a party to an online dispute the right to appeal to it within fourteen days from the date of the dispute, and section 90 allows a further appeal to the High Court within fourteen days from the date of the Tribunal's decision.

3The Tribunal (online gambling activity)Fourteen days from the date of the dispute (s.80)
4The High CourtFourteen days from the date of the Tribunal's decision (s.90)

The Act does not state how the "date of the dispute" is fixed, so do not wait on the licensee's last reply to start counting. Act early and keep dated written records of each exchange.

When the dispute is about a late payment

A different rule applies where a bet was correctly settled as a win but the money did not arrive. Regulation 104 provides that a licensee that fails to pay winnings to a player within 14 days is liable to a penalty of 5% of the total winnings payable to the Authority, and must still pay the outstanding amount plus interest.

Illustrative example. A bet wins KES 4,000 and is not paid within 14 days. The penalty payable to the Authority is 5% of KES 4,000, which is 0.05 x 4,000 = KES 200. That sum goes to the Authority; the player is owed the KES 4,000 plus the interest the regulation describes.

What the record-keeping rule adds

Regulation 91(1) requires a licensee to maintain accurate records of tickets accepted and settled, player accounts, and complaints lodged and disputes resolved. A licensee therefore holds its own record of your bet and of your complaint. A dated message from you makes sure that record exists and matches yours.

What not to do

Do not rely on a phone call alone, because nothing can be checked later. Do not hand over your password or one-time codes to anyone offering to "reverse" a settlement, and do not pay a third party to have a bet changed. The only routes the Act and regulations describe are the licensee, the Authority and the Tribunal. Questions and answers

Who do I complain to first about a wrongly settled bet?

The licensee's customer care centre. Regulation 9 of the Conduct of Gambling Operations Regulations, 2026 says the centre exists to resolve complaints or disputes before they are reported to the Authority, and to refer any unresolved matter to the Authority for determination.

What is the deadline for going to the Tribunal?

Section 80 of the Gambling Control Act, 2025 allows a party to a dispute arising out of an online gambling activity to appeal to the Tribunal within fourteen days from the date of the dispute. The text does not say how that date is fixed, so keep a written record of when the disagreement began.

Does the law say how long the licensee has to answer a complaint?

Not in the provisions read for this guide. Regulation 9 says the centre must report to the Authority within two days any matter raised by the public, but it sets no reply time for the bettor. Do not assume a period that the text does not give.

Can I dispute a bet settled under the rules I agreed to?

Regulation 24(1) requires settlement in accordance with the published rules, so a settlement that follows them is hard to challenge on the rules alone. A dispute is stronger where you can show the rules were applied differently from how they read, or that the data used was wrong.

What does the Tribunal actually decide?

Section 88(9) of the Act gives the Tribunal the function of hearing and determining appeals, including appeals against any decision of the Authority and complaints arising out of the outcome of a gambling transaction. It regulates its own procedure, save as the Act provides.

Is there a further appeal after the Tribunal?

Section 90 of the Act allows a person aggrieved by a decision of the Tribunal to appeal to the High Court within fourteen days from the date of the decision of the Tribunal.
